Work Permit of Taiwan

A person is required to obtain a work permit in order work in Taiwan, unless otherwise specified by relevant laws and regulations.

The definition of {work}

Article 43, the Employment Service Act

“Unless otherwise specified in the Act, no foreign worker may engage in work within the Republic of China should his/her employer have not yet obtained a permit via application therefore.”

According to the official letter No. 1070507378 from Ministry of Labor dated on November 27, 2018:

“…Work permit is exempted, if meeting the circumstances listed in the attached table, which do not fall within the scope of Article 43 of Employment Service Act, with the condition that the job opportunities of the R.O.C. nationals are not jeopardized.”

Common Types of

Work Permit

Ministry of Labor currently open to foreign professionals to be employed or assigned with white-collar occupation, including the 7 major types of work permit.

A. Specialized or Technical Works

B. The Director or Manger of an Approved Business

     Invested or Established by Overseas Chinese or 

     Foreigner(s)

C. School Teacher

D. Full-time Foreign Teacher in Cram School

E. Sports Coaching or Athlete

F. Arts and Performing Arts

G. Contracting Foreigners

The following types are also open to professionals who are expected to apply for work permits besides the 7 major types.

Professional Knowledge or Skills for Short- term Supplementary Learning Centers

  1. Technical creation or technical teaching in the digital content industry

  2. Teaching with specialized knowledge or skills approved by the central competent authority in consultation with the Ministry of Education.

N00.
Foreign Professional Artist

  1. Performing and Visual Arts

  2. Publication

  3. Motion Picture, Radio, TV and POP Music

4. Craft Arts

5. Others

Those who meet the following special status may apply for work permits with Ministry of Labor in order to work in Taiwan.

Those meeting the requirement of Article 51 under the Employment Service Act

  1. A refugee permitted to stay in the Republic of China.

  2. One permitted to live with his/her lineal relative who has a registered domestic residence in the Republic of China.

  3. One permitted to stay permanently in the territory of the Republic of China.

Foreign Students, Overseas Chinese Students and Ethnic Chinese Students

Foreign, overseas Chinese, Hong Kong and Macau students who have been officially enrolled in a school to take courses in a division, department or graduate institute
To take language course(s) for one year or more
With the exception of the winter and summer vacations, their sum of working hours shall not exceed 20 hours per week

Foreign Professionals Adult Child

Foreign professionals who have been approved for permanent residency while engaging with professional work in Taiwan, their adult children may apply for a work permit with Ministry of Labor without the application through any employer, provided such children have obtained confirmation from the NIA of having met one of the conditions listed below

  1. Having lawfully accumulated ten years of residence in the State, and having been present in the State for more than 270 days in each of those years.

  2. Having entered the State before the age of 14, and having been present in the State for more than 270 days each year.

  3. Having been born in the State, and having lawfully accumulated ten years of residence in the State, and having been present in the State for more than 183 days in each of those years.

Blue-Collar Occupation

For blue-collar workers who are expected to enter Taiwan and engage with the works as stipulated in Article 46, Paragraph 1, Paragraphs 8 to 10 of the Employment Service Act, may apply for work permit too. However, the application method is different with white-collar occupation, and thus omitted here as it is not part of Platalea service.

Work Permit vs. ARC

Work Permit: A permit that prove the holder can legally work in Taiwan.

ARC:An identity document that prove the holder can stay in Taiwan.

Not all who have obtain the work permit can apply for ARC and live in Taiwan on a permanent basis.

Likewise, not all who have obtained the ARC can legally work in Taiwan.

Employment Services Act

§48

  1. A foreign worker to be employed as consultant or researcher by the respective government or their subordinate academic research institutes.

  2. A foreign worker has married a national of the Republic of China with a registered residence in the Republic of China and has been permitted to stay therein.

  3. A foreigner employed at a public or registered private college/university in the field of a course of lectures or an academic research approved by the Ministry of Education.

Working Holiday Visa Holders

Such visa is granted on the basis of an international written agreement specifying the foreign work permit, 
the number of people and the period of residence (stay) although the primary purpose of such agreement is not to enter the Taiwan to work.
The period deemed as work permit referred shall not be longer than one year.
